ACCEPTABLE USE POLICY ("AUP")

  1. Unacceptable Use. ZenShows requires that all customers and other users of ZenShows cloud-based service (the "Service") conduct themselves with respect for others. In particular, observe the following rules in your use of the Service:
    1. Abusive Behavior: Do not harass, threaten, or defame any person or entity. Do not contact any person who has requested no further contact. Do not use ethnic or religious slurs against any person or group.
    2. Privacy: Do not violate the privacy rights of any person. Do not collect or disclose any personal address, social security number, or other personally identifiable information without each holder's written permission. Do not cooperate in or facilitate identity theft.
    3. Intellectual Property: Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not reproduce, publish, or disseminate software, audio recordings, video recordings, photographs, articles, or other works of authorship without the written permission of the copyright holder.
    4. Hacking, Viruses, & Network Attacks: Do not access any computer or communications system without authorization, including the computers used to provide the Service. Do not attempt to penetrate or disable any security system. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website. Do not attempt to access or otherwise interfere with the accounts of other users of the Service.
    5. Spam: Do not send bulk unsolicited e-mails ("Spam") or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.
    6. Fraud: Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
    7. Violations of Law: Do not violate any law.
  2. Consequences of Violation. Violation of this Acceptable Use Policy (this "AUP") may lead to suspension or termination of the user's account or legal action. In addition, the user may be required to pay for the costs of investigation and remedial action related to AUP violations. ZenShows reserves the right to take any other remedial action it sees fit.
  3. Reporting Unacceptable Use. ZenShows requests that anyone with information about a violation of this AUP report it via e-mail to the following address: legal@zenshows.com. Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including e-mail or IP (Internet Protocol) address if available, as well as details of the violation.
  4. Revision of AUP. ZenShows may change this AUP at any time by posting a new version on this page and/or sending the user written notice thereof. The new version will become effective on the date of such notice.

PRIVACY POLICY

We collect certain information through our website, located at zenshows.com or zen.show (our "Website") or derivations thereof, including through the products and services provided at the Website. This page (this "Privacy Policy") lays out our policies and procedures surrounding the collection and handling of any such information that identifies an individual user or that could be used to contact or locate him or her ("Personally Identifiable Information" or "PII").

This Privacy Policy applies only to our Website and to the products and services provided through our Website. It does not apply to any third party site or service linked to our Website or recommended or referred by our Website, through our products or services, or by our staff. And it does not apply to any other website, product, or service operated by our company, or to any of our offline activities.

A. PII We Collect

We may collect the following Personally Identifiable Information from users who use our services: name, e-mail address, telephone number, address, and GPS coordinates.

We also use "cookies" to collect certain information from all users, including visitors who don't have and account or subscribe to the service. A cookie is a string of data our system sends to your computer and then uses to identify your computer when you return to our Website. Cookies give us usage data, like how often you visit, where you go at the site, and what you do.

B. Our Use of PII

We use your Personally Identifiable Information to create your account, to communicate with you about services facilitated through the website, and to bill you. We also use that information to the extent necessary to enforce our Website terms of service and to prevent imminent harm to persons or property.

We use cookies so that our Website can remember you and provide you with the information you're most likely to need. For instance, when you return to our Website, cookies identify you and prompt the site to provide your username (not your password), so you can sign in more quickly. Cookies also allow our Website keep track of your current settings and configurations while you are using the site. Finally, we use information gained through cookies to compile statistical information about use of our Website, such as the time users spend at the site and the pages they visit most often. Those statistics do not include PII.

C. Protection of PII

We employ the following data security tools to protect Personally Identifiable Information: All pages are served through SSL technology, all user passwords are securely stored through industry standard hash algorithms, all data is protected inside a secure area on our server, the server is located in a secure environment. Unfortunately, even with these measures, we cannot guarantee the security of PII. By using our Website, you acknowledge and agree that we make no such guarantee, and that you use our Website at your own risk.

D. Contractor and Other Third Party Access to PII

We give certain independent contractors access to Personally Identifiable Information. Those contractors assist us with development of the website and its services. All those contractors are required to sign contracts in which they promise to protect PII using procedures reasonably similar to ours. (Users are not third party beneficiaries of those contracts.) We also may disclose PII to attorneys, collection agencies, or law enforcement authorities to address potential AUP violations, other contract violations, or illegal behavior. And we disclose any information demanded in a court order or otherwise required by law or to prevent imminent harm to persons or property. Finally, we may share PII in connection with a corporate transaction, like a merger or sale of our company, or a sale of all or substantially all of our assets or of the product or service line you received from us, or a bankruptcy.

As noted above, we compile Website usage statistics from data collected through cookies. We may publish those statistics or share them with third parties, but they don't include PII.

Except as set forth in this Privacy Policy, we do not share PII with third parties.

E. Accessing and Correcting Your PII

You can access and change any Personally Identifiable Information we store through your "Profile" page.

F. Amendment of This Privacy Policy

We may change this Privacy Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the date it's posted, which will be listed at the bottom of the page as the new Effective Date.

A NOTE ABOUT GPS DATA

Many users are confused and/or scared by the use of GPS (Global Positioning System) tracking technology through their phones. Hopefully the following will help ease concerns around the use of this technology with ZenShows:

  1. ZenShows will only acquire your location information from the checkin/out page when you click on the button to check in or out or when a datacollector form is sent to you with a location enabled capture button. ZenShows will first try to find a high accuracy location using your phones hardware and if unsuccessful will try to find a low accuracy location. Once ZenShows has gone through this process whether successful or not, ZenShows will not try to find your location again until you press the button again.
  2. ZenShows does NOT continue to track your location after you have checked in or out. Your phone may continue to refine your location but that additional data will not be available to ZenShows unless you press the check in/out button again.
  3. ZenShows will only be able to get your location if A) your phone is enabled for GPS tracking B) your web browser on your phone is enabled for GPS tracking and C) you have given permission for ZenShows to use GPS tracking.
  4. When you check in or out using GPS tracking, your coordinates are transmitted to the ZenShows website securely in industry standard encrypted format. Furthermore, the information sent to our servers is identified by your user_id which is not public information.
  5. ZenShows stores this tracking information in our database along with other information related to the event you are attending. This information is covered under our PRIVACY POLICY.

MESSAGE AND DATA RATES MAY APPLY

ZenShows uses texting (SMS communications) and mobile data extensively that is generally provided through cellular carrier technology with your phone plan. ZenShows will not charge a fee for the delivery of this data but your mobile service carrier may just as they would for any Text message you receive.

  1. Message and Data Rates May Apply: your wireless carrier’s standard messaging rates apply to your entry or submission message, our confirmation and all subsequent SMS correspondence. CapStar Bank does not charge for any content; however, downloadable content may incur additional charges from your wireless carrier. Please contact your wireless carrier for information about your messaging plan. Your carrier may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your wireless carrier.
  2. Supported carriers include, but are not limited to, Verizon Wireless, AT&T, T-Mobile, Metro PCS, Sprint, Boost, Virgin Mobile USA, and U.S. Cellular.
  3. By using ZenShows, you consent to receiving/sending texts and data andthus incurring possible charges through your carriers plan. Use of the website is voluntary and all emails and text messages can be disabled through your profile by logging into the website or by emailing support@zenshows.com.
  4. You represent that you are the owner, or authorized user of the wireless device you use to subscribe to the service, and that you are authorized to approve the applicable charges.
  5. We will not be liable for any delays or failures in your receipt of any SMS messages as delivery is subject to effective transmission from your network operator and processing by your mobile device. SMS message services are provided on an AS IS AVAILABLE basis.
  6. Data obtained from you in connection with this SMS service may include your mobile phone number, your carrier's name, and the date, time and content of your messages and other information that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop and improve the service. Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We will only use the information you provide to the service to transmit your text message or as otherwise described in this document. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the service, you agree to provide accurate, complete, and true information.
  7. The service as well as the content and materials received through the service are proprietary to us and our licensors, and are for your personal, non-commercial use only. You shall not damage, impair, interfere with or disrupt the service or its functionality.
  8. The service is available only in the United States.
  9. We reserve the right to alter charges and/or these terms and conditions from time to time. We may suspend or terminate the service to you if we believe you are in breach of our terms and conditions. Your service is also subject to termination in the event your wireless service terminates or lapses. We may discontinue the service at any time.
